General Terms

1. Applicability

These Terms apply to every business that creates a Proust account.

Proust provides proust.dev and the Proust interview service (the "Service"). In these Terms, "you" means the business that creates the account.

You accept these Terms, the Privacy Notice, the Data Processing Agreement and the Confidentiality Agreement by ticking the box when you create your account. By ticking it, you confirm that you are allowed to accept them for your business. We record which account accepted, which version, and when.

2. Definitions

"Interviewer" means the AI interviewer you configure in the Service.

"Interview data" means the transcripts, analyses and insights from interviews run under your account, and the identifiers and fields you attach to them.

"Participant" means a person who takes an interview.

"Reward" means what a participant receives after an approved interview: a code you supply, or cash to Venmo.

3. Description of the Service

The Service lets you create an interviewer and share it as a link, an embed on your site, or a QR code. A participant has a short conversation with it, by voice or by typing. You receive the transcript and an analysis. The participant may earn a reward.

4. Use of the Service

When you use the Service, you must:

• use interview data in line with the laws that apply to your business;
• treat every question you set as visible to participants;
• not ask for passwords, payment card numbers, government ID numbers or health records;
• review each interview before its reward is sent. Interviews you have not reviewed after 72 hours are approved automatically, and their rewards are sent;
• take responsibility for any customer email or ID you put in an interview link. Proust does not verify it.

You must not use the Service to:

• pretend to be a business you do not represent, or mislead participants about who receives their answers;
• interview anyone under 16;
• harass, threaten or demean anyone, or collect sexually explicit content;
• run phishing, malware, or anything that gets around Proust's security or reward controls;
• resell access, or run one account across unrelated businesses.

If an interviewer breaks these rules, we remove it. In serious cases we close the account.

5. Licence and limitations

You may use the Service for your business under a revocable, non-exclusive, non-transferable licence for as long as you hold an account.

6. Invoicing and payment

Setting up interviewers, testing them yourself and sharing your link, embed or QR code are free. Each account includes the free interviews shown on the pricing page.

After that, you pay for every interview taken, at the rates on the pricing page, from a balance you add to your account. An interview you reject is billed too; only its reward is not sent. Rewards you fund are passed through at cost.

We give 30 days' notice before a price changes.

If your usage stays far outside normal for months, we contact you to agree a plan. No interview is stopped while it is running.

7. Intellectual property

You own your interview data. Participants own their words. Proust owns the Service, its software and its templates.

8. Privacy and data protection

For your account data, Proust is the controller; the Privacy Notice applies. For interview data, you are the controller and Proust is the processor; the Data Processing Agreement applies. The contact details a participant gives to receive a reward are handled by Proust as described in the Privacy Notice and are not disclosed to you.

9. Support, updates and changes

Questions about the Service go to info@proust.dev.

The Service is provided as is. We work to keep it available and do not promise that it will never be interrupted.

When these Terms change, we publish the new version with its effective date. For a material change, account holders get 30 days' notice. Using the Service after the effective date, or accepting the new version when asked, means you accept it.

10. Liability

Each party's liability under these Terms is capped at the fees you paid in the 12 months before the claim. Neither party is liable for indirect or consequential loss.

11. Warranties

You warrant that you are allowed to bind your business, and that your use of interview data follows the laws that apply to you.

12. Duration and termination

These Terms apply for as long as you hold an account. Either of us can end them at any time. When your account closes, your data is handled as the Data Processing Agreement and the Privacy Notice describe.

13. Miscellaneous

These Terms are governed by the laws of California, USA. If a clause is found invalid, the rest remain in force.

Special Terms for Participants

1. Applicability

These Special Terms apply to participants. Participants are not party to the General Terms. These rules are shown to them before they start an interview.

2. Eligibility

A participant must be 16 or older and able to receive the reward where they live.

3. Rewards

The business sets how often one person can be rewarded: once a day, once a month or once every 90 days.

A reward is sent after the business approves the interview. Interviews are reviewed for relevance, effort and comprehensiveness. Automated or copied answers do not earn a reward. A reward claimed by fraud is void.

4. Privacy

How a participant's conversation is handled is described at proust.dev/privacy. A participant can ask for their data to be deleted by emailing info@proust.dev.

5. Disputes

Disputes between Proust and a participant are settled by individual binding arbitration. There are no class actions. Small-claims court remains available.

6. Participant pool

Joining the participant pool is optional and separate from any interview or reward. To join, a participant must be 18 or older. Proust keeps the participant's email and interview history and emails them when other brands are looking for people for compensated interviews. A participant can unsubscribe at any time.
