Terms of Use
Draft — this text is pending legal review and may change before it is final. It is the click-through version of the Terms & Conditions in the help center, accepted once per account when the account is created.
These Terms of Use ("Terms") are between Proust and the business that creates a Proust account ("you", "Customer"). They govern your use of proust.dev and the Proust interview service (the "Service"). By creating an account and ticking the acceptance box you agree to these Terms, the Privacy Policy, the Data Processing Agreement and the Mutual NDA, and you confirm that you are authorized to accept them on behalf of your business. The accepting account, the version and the time of acceptance are recorded.
1. What Proust does
Proust provides AI-conducted interviews at the point of experience: businesses create an interviewer, place a QR code or embed, and receive transcripts and analysis; participants have a short conversation and may earn a reward.
2. General
License. A revocable, non-exclusive, non-transferable right to use the Service for your business.
Your content. You own your interview data; participants own their words. Proust owns the Service, its software, and its templates.
Payment. Usage-based billing as described on the pricing page; price changes with 30 days' notice.
Service. Provided "as is"; we target high availability but do not warrant uninterrupted service.
Liability. Capped at the fees paid in the preceding 12 months; no consequential damages.
Termination. Either side can end at any time; on closure, data is handled per the Data Processing Agreement and the Privacy Policy.
Fair use. Drafting interviewers, printing QRs, and testing your own interviews are free and effectively unlimited; you pay for real interview minutes as they land. If usage is consistently far outside normal for months, we reach out and work out a plan — nothing abrupt, nobody is cut off mid-conversation.
Law. California, USA.
3. Special terms — businesses
You warrant that you have authority to bind your company, and that your use of interview data complies with the laws that apply to your business.
You are the controller of your interview data; treat interview questions as participant-visible by definition.
Don't use Proust to collect data you shouldn't: passwords, payment card numbers, government IDs, or health records have no place in an interview.
Don't use Proust to impersonate a business you don't represent, to deceive participants about who receives their answers, to interview children under 16, or for harassment, hate, sexually explicit content, phishing, or circumventing Proust's security or reward controls. Violations lead to removal of the interviewer and, for serious cases, the account.
4. Special terms — participants
Rewards. One rewarded interview per person per venue per day unless the venue says otherwise. Rewards require a genuine, on-topic conversation — low-effort or automated responses don't qualify. Fraudulent claims are void.
Eligibility. Participants must be 16 or older, and able to receive payouts where they live.
Their data. How a participant's conversation is handled is described in the participant privacy page at proust.dev/privacy; deletion is one email away (privacy@proust.dev).
Disputes. Individual binding arbitration; no class actions. (Small-claims court always remains available.)
5. Changes
We post changes to these Terms with a new version and effective date; material changes get 30 days' notice to account holders. Continued use after the effective date, or re-acceptance when prompted, constitutes acceptance of the new version.
